The CBI was set up on April 1, 1963 by a resolution by
the Ministry of Home Affairs under DSPE Act, 1946.
ü
On November 7, 2013 the High Court quashed the Union Home
Ministry’s resolution through which the CBI was constituted in 1963.
ü
The Court said the CBI is neither an organ nor part of
the DSPE, hence cannot be treated as police force under DSPE Act.
ü
The court declared that the DSPE Act is not a valid piece
of legislation and hence quashed the resolution order of April 1, 1963.
ü
A careful reading of the preamble of the DSPE Act, it is
evident that the act has been made for Union Territories. This legislative
power cannot be exercised by the parliament except under article 246 (4) of
the Indian Constitution. This enables the parliament to enact laws on subjects
covered by State list in respect of Union territories.
ü
On the verdict of the High Court the central government
is planning to move the Supreme Court at the earliest.
