SUPREME COURT VERDICT ON DEATH SENTENCE

It is a Historical day with reference to uphold the spirit of Article 21 of the Indian Constitution.

Article 21: No person shall be deprived of his life or personal liberty except according to procedure established by law.


On January 21, 2014 the Apex Court commuted the death sentence of 15 convicts to life term on the grounds of delay in deciding their mercy petitions by the President. The Court said that the delay in deciding mercy plea is a relevant ground from commuting death sentence to life imprisonment. The court also said that every person on death row has a right to approach Supreme Court to challenge the rejection of pleas on the grounds of inordinate delay.

1. Delay in deciding mercy plea  is a relevant ground for commuting death sentence to life imprisonment 


2. Death sentence of a condemned prisoner cannot be executed if he is suffering from mental illness and schizophrenia and must be commuted to life imprisonment 


 3. Solitary confinement of a death convict and other prisoners is unconstitutional 


 4. A death convict must be hanged within 14 days after dismissal of his mercy petition 


 5. Death convict and his family members must be informed after his mercy plea is rejected by the President or governor 


 6. Legal aid be provided inside jail to the condemned prisoners 


 7. Condemned prisoners must be given a chance to meet their family members before execution of death sentence
